This notice oversees your association with ExperienceNaija. These terms and conditions and some other lawful notification, approaches and rules of ExperienceNaija connected to these terms and conditions constitute the whole agreement between you and ExperienceNaija thus identifying with your utilization of the Services provided by ExperienceNaija, and supersedes any earlier understandings or agreements (regardless of whether oral or composed).

The utilization of these Services is administered by the Terms and Conditions put forward. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE SUBSCRIBING TO OUR PRODUCTS AND SERVICES. This notice applies to subscribers and potential subscribers to the ExperienceNaija Service, both now and later on. On the off chance that you do not consent to these Terms and Conditions of Use, kindly seize from subscribing to our Service.

We may suspend or quit giving our Services to you on the off chance that you do not conform to our terms and conditions, or/and in the event that we are examining speculated wrongdoing.

Service provision

ExperiecneNaija is a photo-tourism venture which caters for destination tourism with a blend of photography, cuisine and events all packaged in one experience. As such ExperienceNaija agrees to offer the following:

We intend to offer participating tourists[1] fully air-conditioned luxury tour vehicles with security, tour Services, photography Services, five-course cuisine, cultural and art display, visits to monuments and other locations of interest within a three-hour package.

Fully air-conditioned luxury tour vehicles:

ExperienceNaija is liable to provide subscribers with our Service, convenient fully air-conditioned luxury tour vehicles in the execution of Services subscribed to. ExperienceNaija ensures that the drivers and vehicles employed for each of its trips are in perfect condition to drive. Furthermore, ExperienceNaija ensures that all drivers are licensed, and tourists carrying vehicles road worthy. Consequently, ExperienceNaija excludes itself from any liability due to accidents or delays with exception to where the causes of the accidents or delays have been contributed to in any measure by the negligence of ExperienceNaija. In such a case, ExperienceNaija is liable to compensate subscribers for resulting damages.

Security:

ExperienceNaija, given the manner of Service it provides, holds the safety and security of its tourists in utmost regards. As a result, The ExperienceNaija group is in collaboration with the Nigerian Police Command and the Department of State Services (DSS) to ensure the following:

  • Much needed security clearance for ExperienceNaija intentions and activities
  • Access to some presently restricted locations with very high tourism potential.
  • Having security personnel as security and monitoring on each of ExperienceNaija tour trips
  • Having the presence of security personnel as security at each of our destination location
  • ExperienceNaija are and remain meticulously security compliant in the execution of our activities

Regardless, we are not at risk for undesirable causalities of any shape amid the span of the products or/and Services we give (from pick-up to drop-off point) unless caused exclusively by our gross carelessness, in which occasion you will be qualified for compensation on any such resulting damages or casualties.

Photography Services:

ExperienceNaija offers a unique photo-tourism experience and as such will ensure to use photography to capture moments of the tour Service as much as possible. ExperienceNaija reserves the right to take photographs of tourists at any point in time with or without the consent and awareness of the tourists.  Also, by agreeing to this terms and conditions, ExperienceNaija has limited copyright of these photographs together with the right of reproduction either wholly or in part. Further, ExperienceNaija is assigned the right to use and publish video and /or photographs of tourists as we see fit. However, ExperienceNaija will not use photographers for any other reason other than for providing tourists with their photo-tourism experience photos and for any ExperienceNaija promotional activities where testimonial photos may be required.

All reproduction of photographs taken are deemed to represent an imaginary person and words that may be attached to those photos in the manner in which they are used, will not be attributed to the tourists identifiable in the photographs. By agreeing to this notice, ExperienceNaija will not be subject to any legal proceedings, claims or demands in respect of any usage of the photographs taken. ExperienceNaija is released from all claims and liability relating to images, videos or photographs taken of tourists.

Photography Services will be given to tourists as benefits of the package subscribed in accordance with the package specifications as is visible on the ExperienceNaija website. However, Tourists reserve the right to demand all existing photographs solely involving them as extra free benefits. Nonetheless, the additional photos supplied outside the scope specified within the subscribed package description will be may be watermarked with the ExperienceNaija logo solely for promotional purpose.

Course Cuisine:

As part of the ExperienceNaija tour Service, ExperienceNaija is liable to provide course cuisines to its tourists according to the product package specifications outlined. Consequently, ExperienceNaija, in collaboration with the culinary Service providing entity, reserves the right to the portion and choice of the cuisine to be offered to the tourist. ExperienceNaija reserves the exclusive right to determine the culinary Service providing entity. Cuisines to be offered covers the broad speck of anything edible and digestible by the human body.

Tour Services:

ExperienceNaija provides its subscribers with visits to various locations within the city of residence. In addition, ExperienceNaija agrees to provide tourists with cultural and art display, and other entertainment activities to enhance the photo-tourism experience of tourists. Nonetheless, ExperienceNaija has the exclusive right to the set, type and number of locations to be visited by the tourists. ExperienceNaija is however obliged to offer visits to as many venues specified in the product package subscribed to by tourists. In the case of a need to amend the number of venues to be visited, ExperienceNaija must reflect such decision in the product package specification visible on the ExperienceNaija website.

In as much as ExperienceNaija makes it part of its Service to provide cultural and arts displays, as well as other entertainment themes, ExperienceNaija does not in any way guarantee the presence of such organized entertainment on tour trip session and thus reserves the right over when, how, where and what entertainment theme to be delivered to enhance the photo-tourism experience. ExperienceNaija wishes to offer its Services within three hours. However, while measures will be taken to do so while yet ensuring tourists get full customer satisfaction, ExperienceNaija ensures to not purposely or inadvertently guarantee that the three hour time frame will always be kept, and as such is not liable legal proceeding, rights or claims that may result from extending the provision of its Service beyond the stipulated time frame. Accordingly, ExperienceNaija Services may exceed the stipulated time frame but will not go below the stipulated time frame unless in the case of necessity for the safety and security concerns of the tourists. ExperienceNaija will not be liable for delays and the shortening or extending of the stipulated time frames caused by force majeure or any circumstances clearly out of ExperienceNaija’s control.

Website subscription

Subscription to any of our product packages as identified on the website is to be done online. Consequently, ExperienceNaija requests users own accounts via which they will be able to subscribe so as to have access to products. No subscription to our product packages can be made without users possessing user accounts on our platform. This is in adherence to our safety and security measure as per our privacy policy. Involved in the subscription process is a registration form users are expected to fill. During registration, users will be requested of personal information as per our privacy policy

In addition to the requested personal information, our website will also request the user to upload a recent passport photograph. Other information requested would concern credit or master card details as the only viable payment options for ExperienceNaija product packages.

Agent subscription

ExperienceNaija allows for user subscription to be done by third party agents. This third party subscription is also subject to the terms and conditions governing product package subscription. Where an agent is attempting to make a subscription for his/her client, he/she is still requested to provide the same information for his/her client as the client would have done if they were registering as an individual. Also, we would, at this point, like to bode out that third party registration of a tourist (i.e. via an agent) would require the sharing of personal data between the prospective tourist and the agent. Consequently, ExperienceNaija does not take responsibility for information shared outside of our platform and as such crave the indulgence of prospective tourists to ensure the credibility of the agent who subscribes on their behalf. Howbeit, ExperienceNaija shares with its users its registered agents authorized by ExperienceNaija to subscribe tourists on our and their behalf. This information would be constantly updated where the need arises and thus should be viewed by the user frequently.

The Information we collect when you register to ExperienceNaija forms the data base for your ExperienceNaija account and as such, is treated as personal information as per our privacy policy. Consequently, when subscribing to any of our products you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to subscribe and that there are sufficient funds to cover the cost of Service. All prices advertised are subject to such change.

Product package pricing

The prices for each ExperienceNaija package are clearly available on the website. ExperienceNaija may at any time revise and update the pricing of its Services without the consent and obligation of its users. However, alterations to prices for Services will be visible on the website and as such cannot slip the awareness of the prospective subscriber. Continued subscription to the ExperienceNaija Services after any such changes shall constitute your agreement to such changes. Changes will not be applicable to any subscriptions which have been made before production of the altered Conditions.

Payment

Payment for subscriptions made on our site is entirely online. We acknowledge credit and debit cards from recognized banks. Your card will be charged when you click on the ‘Subscribe Now’ option. Do note that payment made for any subscription is not subject to refund under any circumstance, thus booked trips will only be rescheduled not cancelled. In the case of cancellation, the subscriber agrees to forfeit payment made on package subscribed to.

Pick-up time:

Please be informed that the pick-up time will not tarry. However, 5-15mins will be allocated for gathering and to get passengers checked-in, seated and ready for their experience wherein your ExperienceNaija ticket and ID plus a form of verification (e.g. Driver’s license) is required. ExperienceNaija aims to make available processes via which a prospective tourist can be verified to enjoy our Services in the case of forgotten documents. However, ExperienceNaija does not guarantee that these processes/backup verification system will always be available and hence subscribers are advised to always come with their ExperienceNaija ticket and ID plus a form of verification (e.g. Driver’s license) as required. ExperienceNaija, therefore, has the prerogative to disallow offering its Service to tourists if the prerequisite documents are not available for verification and authentication, and will be released from any legal proceedings, complaints, rights and/or claims that may result from the exercise of the related ExperienceNaija right.

Furthermore, should a tourist arrive passed the pickup time and the pickup vehicle has taken off, ExperienceNaija would consider that as a missed trip and tourists will be seen to have forfeited his/her experience unless ExperienceNaija is contacted otherwise within the next 3 days. You are therefore requested to be present at the stipulated pick-up venue at least 30mins before pick-up time. Pick-up time and venue are located on your ticket. I promise you can’t miss the venue.

Pickup venue:

ExperienceNaija is obligated to inform prospective tourist of the pickup venue where the tourist is to be at pickup time. ExperienceNaija ensures to do so by providing such information on the ticket purchased. ExperienceNaija takes extra effort in ensuring that the selected venue is easily accessible and is one of the most popular landmarks in the city thus eliminating room for possible confusion. Consequently, ExperienceNaija is not liable for any inconveniences that may occur as a result of a tourist not present at the pick-up venue at pickup time.

Ticket:

Payment made for a ticket is non-refundable with exception to the case where operational difficulties on our side cause us to be unable to provide due Service on payment made. Ticket purchased grants permission for only the specified number of passengers/ticket delineated on the ticket. For example, if a ticket specifies 1 passenger/ticket, this means that only one living visible person is permitted by virtue of the ticket held. In such regards, this ticket will not permit a mother and child as there would have to be another ticket purchased for the child also.

In the case of rescheduling, please inform the ExperienceNaija team 10hrs before pick-up time. Failure to do so would infer a missed trip and you would have to reschedule at a fixed amount.

Once a ticket is purchased, it is expected that tourist will be present for the trip from start to finish i.e. from pick-up to drop-off. Consequently, if the tourist, for some reason deemed necessary, is unable to meet this expectation, the tourist will be allowed to leave conditioned on tourist’s adherence to proper safety & security measures given by the ExperienceNaija team. However, according to terms and conditions on ticket purchase, it will be assumed that the tourist completed his/her experience package from pick-up to drop-off. In addition, the extent to which the benefits of the package purchased would be availed to the tourist is at the discretion of the ExperienceNaija team.

Prohibitions:

There is no smoking in the bus. Off the bus, smoking permission is under the jurisdiction of the destination location visited. Please note also, that anything that can be considered as a weapon will not be allowed for the trip and will have to be forfeited at check-in point before entering the bus.

Also, cameras, food and beverages are not allowed and will have to be forfeited at check-in point before entering the bus. It is requested that phones be kept on silent or in airplane mode, better yet switched off, throughout the duration of the experience. Forfeited belongings may be retrieved after concluded trip at the drop-off point.

Violation of this statement will be considered as a violation of the terms and conditions of Service and thus ExperienceNaija reserves the right to quit giving our Services with immediate effect.

Luggage:

We request that you restrict your personal belongings to the lowest possible. A mobile phone (portable gadget) and a wallet would suffice. However, if need be to carry belongings exceeding the aforementioned, the ExperienceNaija team will provide a branded ExperienceNaija tourist bag just right for you. Howbeit, do note that the ExperienceNaija team does not claim responsibility for lost belongings.

Need for cash:

It is advised that you bring some cash along with you for the experience as, along with the tour trip, you may come across things that tickle your fancy and worth purchasing. However, keep your cash separated, with some spending money easily accessible and the rest hidden, so that you’re not showing off a big wad of cash every time you pay. ExperienceNaija is not liable for any missing or stolen funds with exception to the rarity where the crime is perpetrated by one of our own. In which case, the affected tourists will be duly and sufficiently compensated accordingly.

Dress code:

Owing largely to cultural considerations, we request that your dress code is largely conservative. Dress code should also be comfortable and allow for much-needed mobility. Accordingly, we request the following:

  1. Dress code should not divulge too much (an inappropriate exposure) skin
  2. Women should please have a scarf/shawl on hand for particular destinations that may require such e.g. National Mosque
  3. Embrace multi purpose shoes like trainers, sneaker, and sports shoes etc. and avoid heels.
  4. Following the stipulated terms for dressing. ExperiecneNaija will not be liable for any inconveniences as a result of tourists straying from the advised.

Online generated verification documents

Consequent upon payment made in subscription to any of ExperienceNaija product packages, the ExperienceNaija platform will generate the subscriber’s ticket, Identification information to be used to develop the tourist’s identity tag, and a pre-tour information pack.

Law and Jurisdiction

These terms are governed by the law of Nigeria and any debate emerging in connection with these terms might be liable to the jurisdiction of the Courts of Nigeria.
